Terms of Service

1. About FindMeStock and these Terms of Service

FindMeStock (“the app”) is operated by HouseApps Limited (“HouseApps”, “we”, “us”), a private limited liability company incorporated under the laws of England and Wales with company number 17243528 and with its registered office at 71–75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom, contactable at support@findmestock.com. By creating an account for the app and/or using the FindMeStock website (findmestock.com) the user (“you”) agrees to the following terms of service as may be amended by us from time to time (“Terms”) and our Privacy Policy which has been published and/or provided to you separately. FindMeStock is available to users in the United Kingdom.

2. Eligibility and your account

You must be at least 13 years old to use FindMeStock. If you are under 18 years old, you need a parent's or guardian's permission to subscribe to Premium. If a parent or guardian tells us that a child subscribed on the FindMeStock website without permission, we will cancel the subscription. FindMeStock is for your own personal, non-commercial use in the United Kingdom.

Keep access to your sign-in email or Apple or Google account secure and tell us promptly if you think someone else has used your account. You are responsible for activity under your account, except where we cause it.

3. The service and stock information

FindMeStock checks independent, third party retailers' (“Retailers”) websites, product feeds and APIs from the Retailers and affiliate networks where they are available, and shows whether products appear to be in stock, at what price, when we last checked the stock, and alerts you when something you track becomes available from a Retailer. We choose which Retailers, products and searches the app covers; this changes over time and the app does not cover every retailer or product. We may stop checking a Retailer at any time.

Our information comes from these sources and from our own checks and can be delayed, incomplete or wrong. Stock and prices can change between our check and your visit. Stock information and alerts are a guide and not an offer or a guarantee: an alert does not reserve stock or guarantee that you will be able to buy the product, at the price stated or at all. An alert does not constitute an offer from us to buy the stock. Always check the Retailer's page, including the price, delivery cost and seller, before you buy.

4. Notifications

To get alerts you need to allow notifications from FindMeStock on your device or browser. Notifications are delivered by Apple, Google and browser push services, which we do not control. An alert may be delayed, held back or not arrive, for example because of your device's settings or connection, and we may not send an alert that is no longer useful. Do not rely on alerts alone for any actions or decisions.

5. Retailers, buying and affiliate links

The stock shown by FindMeStock is owned and/or offered by Retailers. Retailers are independent businesses and we are not affiliated, owned or endorsed by the Retailers unless stated otherwise. We do not sell or offer to sell anything and do not reserve, order or check out stock for you. When you tap Buy, we connect you with the Retailer, and any purchase is a contract between you and the Retailer on its own terms. The Retailer is responsible for its prices, stock, payment, delivery, returns and refunds. Prices we show for any stock are as the Retailer displayed them at our last check and exclude delivery unless we say otherwise; the Retailer's price and other terms at checkout apply.

Some Buy links are affiliate links: if you buy, the Retailer may pay us a commission. This does not change the price you pay, and it never affects how we check stock, what the app shows as in stock, the prices the app shows, the order Retailers appear in or when we alert you. 6. Premium and subscriptions

What Premium includes. Premium adds features and higher limits to the free service. What it includes, its price, its billing period and any free trial are shown before you buy, and form part of your agreement with us. Premium alerts are generally checked more often and sent ahead of free ones, but no alert is guaranteed to be faster or to reach you before a product sells out. Prices are in pounds sterling and are the total you pay.

Renewal and trials. Premium renews automatically at the end of each billing period until you cancel. If you start a free trial, your subscription begins and you are charged when the trial ends unless you cancel before then. Free trials are for people who have not had Premium before.

Where you pay and cancel. The way you subscribe decides how billing, cancellation and refunds work:

• App Store: billed and managed by Apple under its terms. Cancel in your Apple Account settings at least 24 hours before the trial or period ends.
• Google Play: billed and managed by Google under its terms. Cancel in the Play Store.
• The FindMeStock website: billed through our payment provider, Stripe. Cancel in Account → Subscription.

Cancelling stops the next renewal, and you keep Premium until the end of the period you have paid for. We cannot cancel an App Store or Google Play subscription for you. If Premium ends, your account returns to the free service; alerts beyond the free limit are paused, not deleted.

Price changes. A new price applies from your next renewal, never to a period you have paid for. Apple and Google tell their subscribers about price changes. For website subscriptions, we will email you at least 30 days before a new price applies, and you can cancel before it does.

Refunds. Apple and Google handle refunds for their subscriptions under their policies. For website subscriptions, section 7 of these Terms explains your right to cancel; otherwise email support@findmestock.com and we will consider refund requests fairly.

7. Your right to cancel a website subscription

If you subscribe on the FindMeStock website, you can cancel within 14 days of the day you subscribe (including the day a free trial starts), without giving a reason.

When you subscribe, you ask us to start Premium straight away, and you acknowledge that if you cancel within the 14 days you will pay for the Premium you had before you told us. To cancel, email support@findmestock.com, or cancel in Account → Subscription and we will treat that as your notice. You can use our model cancellation form (findmestock.com/terms/cancellation-form), but you do not have to.

If you cancel during a free trial, you are not charged. If you cancel after a payment, we will refund what you paid less a proportionate amount for the days of Premium after the payment and before you told us, to your original payment method, within 14 days of your notice.

8. Deleting your account

You can delete your account at any time in the app or on the FindMeStock website, or by emailing support@findmestock.com from the address on the account. Deleting your account cannot be undone.

• App Store or Google Play subscriptions are not cancelled by deleting your account. Cancel with Apple or Google first, or you will keep being charged.
• Website subscriptions are cancelled immediately. For a yearly plan, we will refund the unused whole months within 14 days. Monthly plans are not refunded. If you are within 14 days of subscribing, section 7 applies instead.

9. Acceptable use, requests and our rights

You agree not to:

• use FindMeStock unlawfully;
• copy, extract or re-use substantial parts of our stock information, stock history or product catalogue, or use them to build or supply another product or service, or resell our alerts or data;
• access FindMeStock by automated means other than the FindMeStock website and apps (search engines may index our public pages), overload, probe or interfere with our systems, or reverse engineer our software except where the law allows;
• get around usage limits or Premium features, for example by using several accounts; or
• send false, abusive or spam requests or reports.

We may limit, suspend or close an account that does not comply with these Terms, and we will tell you why unless the law or security prevents it.

When you send us a request or stock report, you allow us to use it free of charge to run and improve FindMeStock. We cannot promise to add anything you request.

FindMeStock, including its software, design and database of products, listings and stock history, belongs to HouseApps and is protected by copyright and database right. We give you a personal, non-transferable, revocable licence to use it as intended. Retailer and product names and images belong to their owners and do not imply their endorsement.

10. Changes, availability and ending

Changes to FindMeStock. We may change the service, including the Retailers and products we cover, how often we check, and which features are in Free or Premium. If a change significantly reduces Premium features you have paid for, we will give you reasonable notice; for a website subscription you can then cancel and we will refund the unused part of your period, and for App Store and Google Play subscriptions you can cancel and ask the store for a refund. Adding or removing individual Retailers or products is part of how the service normally works and is not a change of this kind.

Availability. We cannot guarantee that FindMeStock will always be available or free from errors. If we close FindMeStock altogether, we will give reasonable notice and refund website subscription fees for the period after it closes.

Suspension and ending. You can stop using FindMeStock at any time. We may suspend or end your access if you break these Terms, or to protect users, Retailers or the service. If we end your access for any other reason, we will refund website subscription fees for the period after it ends.

Changes to these Terms. We may update these Terms at any time. If changes are material, we will give reasonable notice (for example, in the app or on the FindMeStock website) and, where appropriate, ask you to accept the new Terms. Continuing to use the app after changes take effect means you accept them.

11. Disclaimers and limitation of liability

To the fullest extent permitted by law, FindMeStock is provided without warranties of any kind. HouseApps and its directors, employees and officers, shall not be liable for any indirect, incidental, or consequential losses, including but not limited to any lost data or profits arising out of or in connection with your access to or use of the app.

HouseApps and its directors, employees and officers are not responsible for the loss of a chance to buy a product, or for paying more for any product. The app is for personal use only and is not intended for business use.

To the maximum extent permitted by law, the total aggregate liability arising out of or in connection with these Terms or your use of the app shall not exceed the total amount paid by you to us for the use of the app during the 12 months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law.

If your breach of these Terms or misuse of the app causes us, the app or a third party any loss, damage, or cost (including reasonable legal costs and expenses), you agree to be responsible for it, except to the extent it results from our own fault. You agree to indemnify us and our directors, employees and officers for any losses, damages or costs (including reasonable legal costs and expenses) reasonably incurred by us in connection with a third party claim arising as a result of your unlawful use of the app, your breach of these Terms or your infringement of any third party rights. This does not limit your non-excludable rights as a consumer.

12. App stores

If you use the iPhone app, Apple's standard Licensed Application End User License Agreement also applies. Apple is not a party to these Terms and is not responsible for the app or its support.

13. General

You need our consent to transfer your rights under these Terms. We may transfer ours to another business, for example if we sell FindMeStock, and your rights will not be reduced. If any part of these Terms is found invalid or unenforceable, the rest remains in full effect.

14. Complaints and governing law

If you have a complaint, email support@findmestock.com and we will try to resolve it. If we cannot, we will tell you about alternative dispute resolution options.

These Terms are governed by the laws of England and Wales. You can bring proceedings in the courts of England and Wales or, if you live in Scotland or Northern Ireland, in your local courts.
